An AI developer wants to license my content. How much should I charge?

Determining the right licensing fee for your content can be a complicated process, as it depends on various factors such as the type of content, its value, the intended use, and the market demand.

Here are some guidelines to help you get started.

Understand the types of licenses

The AI developer is likely seeking a license to use your content for a specific purpose, such as:

  • Commercial use (e.g., using your content in their product or service)
  • Non-commercial use (e.g., using your content for educational or research purposes)
  • Exclusive use (e.g., the AI developer wants exclusive use of your content)
  • Non-exclusive use (e.g., various parties can use your content)

Assess the value of your content

Consider the following factors to help you determine the value of your content:

  • Uniqueness: Is your content unique, like an exclusive interview with someone, or can it be easily replicated?
  • Quality: Is your content high-quality, well-researched, and engaging? Well researched content, backed by data is very valuable to AI developers.
  • Relevance: Is your content relevant to the AI developer’s use case or target audience?
  • Competition: Is there similar content available in the market?

Research the licensing industry standards

Look at industry standards for licensing fees in your niche or for similar content. You can:

  • Research online marketplaces to see what similar content is selling for.
  • Consult with industry associations or trade organisations for guidance on licensing fees.
  • Research contracts and agreements from other content creators to get an idea of what they’re charging.

Consider the AI developer’s proposal

Review the AI developer’s request and proposal and consider the following:

  • What is the scope of the project, and how will your content be used?
  • What is the expected revenue or profit from the project?
  • Are there any specific requirements or restrictions for the use of your content?

Negotiate a fair price

Based on your research and assessment, negotiate a fair price for your content. Consider the following:

  • Start with a higher price and be willing to negotiate.
  • Consider offering different pricing tiers or packages for different levels of use.
  • Be prepared to provide additional value or services to justify a higher price.

Some general guidelines for licensing fees

For commercial use, you can charge a percentage of the revenue generated by the AI developer’s project (e.g., 5-20%).

For non-commercial use, you can charge a flat fee or a royalty-free license (e.g., $1,000 to $5,000).

For exclusive use, you can charge a higher fee or a percentage of the revenue generated by the AI developer’s project (e.g., 10-50%).

The right licensing fee for your content will depend on your specific situation, and it’s always best to seek legal advice. Be prepared to negotiate and stand up for your content’s value.

You can register your copyrighted content on Contenseo and use the system to license your content and receive payments.

AI developers must reveal copyright violations

Big news for creators, publishers, content owners and copyright holders.

The United States has a new bill that aims to protect copyright holders and creators in the age of AI.

Following many high profile lawsuits accusing generative AI developers of using copyrighted content to train their language models, the “Generative AI Copyright Disclosure Act of 2024,” was introduced by Rep. Adam Schiff. (April 10, 2024)

The Copyright Disclosure Act explained

The Copyright Disclosure Act aims to clarify how AI developers can use copyrighted material.

Under this new law, anyone creating or updating AI training data must inform the Register of Copyrights if they use copyrighted works.

The essence of the new law is all about transparency.

Anyone creating or updating AI training data must inform the Register of Copyrights if they use copyrighted works.

They must submit a summary of all copyright material used before their AI system is publicly launched.

And finally, if they don’t send such information to the Register of Copyrights, they will be fined.

“We’re at a crossroads where respect for intellectual property and technological innovation must coexist,” Schiff asserts, on the bill’s core mission.

In summary

To promote transparency and ensure proper copyright use, the bill establishes key requirements:

  • Detailed summaries: Creators must provide comprehensive summaries of any copyrighted material included in AI training datasets.
  • Timely filings: Submission deadlines are set to guarantee notices are filed well before AI systems are publicly launched.

Financial deterrence: To emphasise the importance of compliance, financial penalties are in place for those who fail to meet these requirements.
